 PLEASE READ THIS CANCELLATION POLICY CAREFULLY. BY SCHEDULING SERVICES WITH US, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE.

This Cancellation Policy (“Cancellation Policy”) applies to your application for services provided by Spectrum Image, Inc., d/b/a Spectrum Aesthetics (“we” or “us”). By scheduling services with us, you agree to this Cancellation Policy, and any terms incorporated by reference.

We may make changes to this Cancellation Policy from time to time. If we make changes, we will provide you with notice of such changes, such as by providing a notice through our Site or by updating the Effective Date. Unless we say otherwise in our notice, the amended Cancellation Policy will be effective immediately, and your continued use of our services after we provide such notice will confirm your acceptance of the changes.

TERMS AND CONDITIONS

We understand that situations may arise that may require a patient to postpone his or her services with us. Scheduling a surgical procedure requires the coordination of many resources, which take time to properly handle. We undertake substantial efforts to provide quality services to our patients. Any changes to the date of service have substantial effect on our surgeons, our operating room and other staff, and other patients.

CANCELLATION AND REFUNDS

If your procedure is cancelled, the following terms apply:

  • Cancellations due to a substantiated medicalcondition will entitle you to receive a refund minus anylaboratory expenses and anesthesiology fees. We must receive written noticeno fewer than thirty (30) days prior to the surgery date with medical proofsubmitted for our review, which shall be determinative in our sole discretion as to whether grounds exist to provide a refund. For purposes of this Cancellation Policy, pregnancy is not considered a medical condition that entitles you to a refund upon cancellation.
  • Cancellation notices received more than thirty (30) days prior the surgerydate will entitle you to receive a refund, minus the nonrefundable deposit of $1,000 (the “Nonrefundable Deposit”) and other incurred fees.
  • Cancellation notices received no less than sixteen (16) days but fewer than twenty-nine (29) days before the surgery date will entitle you to receive a 50% refund, minus the Depositand other incurred fees.
  • Cancellation notices received fifteen (15) days or fewer before the surgery date will not entitle you to a refund whatsoever no matter the circumstances, including but not limited to failure to obtain medical clearance.

RESCHEDULING PROCEDURES

If you reschedule surgery thirty (30) or more days before the date of surgery, you will not be charged any additional fees the first time. An administrative fee of $500 will be charged for any subsequent rescheduling. If you cancel a rescheduled procedure, the above Cancellation and Refunds provision applies; however, under no circumstances whatsoever will you be entitled to a refund of the administrative fee charged for rescheduling.

NO-SHOW POLICY

If you fail to arrive on the date of your surgery, no matter the circumstances, you will not be entitled to any refund whatsoever. In the event that you arrive late and we determine, in our sole and final determination, that your late arrival precludes surgery from occurring as scheduled, then you will forfeit all payment and not be entitled to any refund whatsoever.

FAILURE TO DISCLOSE

In the event you fail to disclose a medical condition to us, which we learn of on the date of surgery, your procedure will be cancelled and you will not be entitled to any refund whatsoever.
